Messaging Policy
Overview
This Messaging Policy describes how Nediv Lev LLC (“Nediv Lev”) operates its SMS and email programs. Nediv Lev is the sender of all SMS and email messages under this program and is responsible for compliance with applicable law and industry standards. Messages promote fundraising campaigns operated by Nediv Lev on behalf of 501(c)(3) beneficiary organizations, and each message identifies Nediv Lev as the sender.
Program Identification
Program name: Nediv Lev Campaigns. Every SMS message includes Nediv Lev’s name. Every email message includes Nediv Lev’s name, a physical mailing address, and a one-click unsubscribe link in accordance with the CAN-SPAM Act. Within each message, the specific 501(c)(3) beneficiary organization for the current campaign is disclosed to subscribers.
Opt-In and Consent
Subscribers join the program through express written consent collected on our website or on a specific campaign intake form. Email and SMS consent are collected as separate, unbundled opt-ins. Consent checkboxes are never pre-checked. Subscribing to messaging is never a condition of making a donation, entering a raffle, or receiving any other benefit.
Consent language presented at the point of opt-in:
“By checking the SMS box and submitting, you agree to receive recurring automated marketing messages from Nediv Lev. Consent is not a condition of donation or entry. You’ll receive up to 2 messages per day. Message and data rates may apply. Text STOP to opt out, HELP for help. View our Terms and Privacy Policy.”
Message Frequency
Message frequency is up to 2 messages per day. Frequency is disclosed at the point of opt-in. Subscribers are not messaged outside the program they opted into.
Opt-Out and Help Keywords
All subscribers can opt out of SMS messages at any time. Replying STOP, UNSUBSCRIBE, CANCEL, END, or QUIT removes the subscriber from the program immediately and triggers a single confirmation message. Replying HELP returns a message with Nediv Lev’s contact information. Email subscribers may unsubscribe using the one-click unsubscribe link included in every message.

- Welcome: “Welcome to Nediv Lev Campaigns! You’ll receive up to 2 msgs/day. Msg & data rates may apply. Reply STOP to opt out, HELP for help.”
- Campaign launch: “Nediv Lev: Our [Month] campaign benefiting [Beneficiary 501(c)(3)] is live! Learn more at [link]. Reply STOP to opt out.”
- Reminder: “Nediv Lev: Last day to participate in this month’s campaign for [Beneficiary]. [link]. Reply STOP to opt out.”
Data Handling
Mobile opt-in data is never shared with third parties or affiliates for their own marketing purposes. Subscriber contact information is used only to operate our messaging program and is held under the terms of our Privacy Policy. Data is not sold, rented, or transferred to unrelated parties.
Regulatory Compliance
The Nediv Lev messaging program is operated in compliance with:
- The Telephone Consumer Protection Act (TCPA)
- The CAN-SPAM Act
- The CTIA Messaging Principles and Best Practices
- Mobile carrier requirements for A2P 10DLC brand and campaign registration
- Applicable state consumer protection statutes
